Welcome to Cuddly Cute Designs! The terms "we", "us" and "our" refer to Cuddly Cute Designs. Cuddly Cute Designs operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Cuddly Cute Designs is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

We make reasonable efforts to describe and display our products accurately. However, colors and appearance may vary slightly because of screen settings, device displays, printers, materials, and normal production differences.
Products will be provided in accordance with the applicable product description and any mandatory rights under applicable law. Nothing in these Terms limits remedies available when a product is defective, materially different from its description, or otherwise does not conform to applicable law.
Product descriptions, availability, and quantities may change without notice. We may discontinue products or limit quantities by person, household, geographic region, or jurisdiction, subject to applicable law.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Cuddly Cute Designs reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Cuddly Cute Designs confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Cuddly Cute Designs may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
Purchases must be used in accordance with the applicable product description and our Terms and Conditions. Digital products may be used only as permitted in those Terms and Conditions. Physical products may be used in personal projects and in finished handmade items offered for sale. Purchasing a physical product does not transfer ownership of the artwork or copyright and does not grant permission to scan, copy, digitize, reproduce, distribute, or use our designs to create digital files, printable products, clipart, patterned paper, or other competing design products.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be shown in your order confirmation email. Taxes may be included in displayed prices or added at checkout depending on the customer’s location and applicable tax rules. Shipping and handling charges are shown at checkout when applicable. Customs duties, import taxes, brokerage fees, or other destination charges may be collected at checkout or charged separately upon delivery, depending on the destination and shipping method. Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
SECTION 5 - SHIPPING AND DELIVERY
Shipping and delivery timeframes are estimates and are not guaranteed. Delays may occur due to carrier operations, weather, customs processing, incorrect address information, or other events outside our reasonable control.
If an order is delayed, lost, damaged, or marked as delivered but cannot be located, please contact us at cuddlycutedesigns@gmail.com so we can review the shipment and help determine the appropriate next steps.
Risk of loss or damage passes to the customer as provided by applicable consumer law. Nothing in these Terms limits any rights or remedies available to customers under applicable law.
SECTION 6 - INTELLECTUAL PROPERTY
Our website and Services, including our name, logos, branding, text, graphics, product previews, photographs, videos, audio, artwork, and site design, are owned by Cuddly Cute Designs or our licensors and are protected by applicable intellectual property laws.
Purchasing or downloading a product does not transfer ownership of the artwork, copyright, trademarks, or other intellectual property. Customers may download and use purchased digital products and may use purchased physical products only as permitted by the applicable product description and our Terms and Conditions.
Except for uses expressly permitted by us, you may not copy, reproduce, distribute, share, resell, republish, upload, transmit, scrape, or otherwise exploit our website content, product previews, raw digital files, or artwork without our prior written permission. All rights not expressly granted are reserved by Cuddly Cute Designs.
The Cuddly Cute Designs name, logo, product names, designs, and slogans may not be used without our prior written permission. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. Other names and trademarks appearing through the Services belong to their respective owners.
SECTION 7 - OPTIONAL THIRD-PARTY TOOLS
We may provide access to optional tools, features, or services operated by third parties. If you choose to use them, your use may also be subject to the third party’s terms and privacy policy.

Cuddly Cute Designs is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Cuddly Cute Designs. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Cuddly Cute Designs, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Cuddly Cute Designs.

Digital products are delivered electronically, and no physical item will be shipped. Customers are responsible for using compatible software and devices and for downloading and securely backing up purchased files.
We make reasonable efforts to provide reliable access to purchased downloads, but we cannot guarantee that download access will remain available indefinitely. If a purchased file is missing, corrupted, or materially different from its product description, please contact us at cuddlycutedesigns@gmail.com.
Digital files are provided only to the purchaser and may not be shared, transferred, resold, or distributed except as expressly permitted in our Terms and Conditions. Purchasing a digital product does not transfer ownership of the artwork, copyright, or other intellectual property.

We may suspend or terminate your access to the Services if you materially violate these Terms, misuse the Services, engage in unlawful activity, or create a security, fraud, or operational risk. SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Cuddly Cute Designs, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
